SUMMARY:Fall 2026 ADR Speaker Series: Against Overbroad Nondisclosures
DESCRIPTION:Wednesday\, October 7\, 2026 from 12:30-1:30pm (PT)\nAgainst Overbroad Nondisclosures\nGilat Bachar\, Associate Professor\, Temple University Beasley School of Law \nVia Zoom \n  \nSettlement NDAs routinely impose sweeping and often perpetual confidentiality obligations\, yet courts rarely scrutinize their breadth\, leaving many plaintiffs unable to discuss traumatic experiences even with trusted confidants and thereby exacerbating psychological harm. To address these costs\, I propose that courts recognize implied mandatory carve-outs for emotionally taxing events\, allowing limited disclosures to professionals and close confidants and recalibrating contract enforcement to better protect vulnerable parties’ well-being. \n  \nGilat Juli Bachar is an Associate Professor of Law at Temple University Beasley School of Law\, where she teaches and writes in the areas of legal ethics\, tort law\, dispute resolution\, and law and psychology. Her paper “Plaintiffs’ Lawyers’ Disclosure Duties” was the winner of the 2025 Warren E. Burger Prize. Bachar’s research combines theoretical analysis with empirical methods to explore how people perceive and make decisions about civil litigation and settlement\, and how civil justice institutions can balance private dispute resolution with the public values of transparency\, accountability\, and social welfare. Before joining Temple\, she was a Visiting Assistant Professor at Villanova School of Law\, a research fellow at the Stanford Center on the Legal Profession and a litigation fellow at the Center for Justice & Accountability in San Francisco. \n  \nRSVP \n  \nMore information on the Fall 2026 Speaker Series \n

SUMMARY:CEALS Presents - Start-Ups and the Law: A Comparison Between Japan and America

DESCRIPTION:  \nWednesday\, October 14\, 2026 from 12:30-1:30pm (PT)\nRethinking Active Listening in ADR\nNicolas Parra-Herrera\, Associate Professor\, Wagner/Holbrook Chair in Negotiation\, S.J. Quinney College of Law\, University of Utah \nIn Person – Deb Colloquium Room @ UC Law SF and Via Zoom \n  \nActive listening has become an overarching concept in ADR\, yet there is no precise discussion of its definition\, what it encompasses\, and how it has filtered into the field. It dissolves into a set of protocols\, communication techniques\, and rhetorical claims that fail to account for the limitations\, potentials\, and contingency of listening. In this talk\, we will analyze what the mandate to “active” listening means in ADR literature. We will show that this literature mixes active listening as a moral mandate\, a professional skill\, and a way of relating to others and oneself. DESCRIPTION:Wednesday\, October 28\, 2026 from 12:30-1:30pm (PT)\nISO Truth: Truth-Seeking and Relational Agency in the Aftermath of Gender-Based Violence\nRachel J. Wechsler\, Associate Professor\, University of Missouri School of Law \nVia Zoom \nRSVP \n  \nGender-based violence survivors’ pursuit of truth is often complicated by systemic discounts to their credibility\, institutional resistance\, and\, particularly in recent years\, a post-truth epistemic environment. Despite these challenges\, survivors consistently exercise individual and collective agency in pursuit of truth in the aftermath of their victimization. I draw on transitional justice and relational agency theory to explore the contours and significance of truth-seeking in relation to gender-based violence\, both for survivors and for wider society. \n\n  \nRachel J. Wechsler is an Associate Professor and the Assistant Director of the Center for the Study of Dispute Resolution at the University of Missouri School of Law. She is also a Faculty Scholar at the University of Missouri’s Middleton Center for Race\, Citizenship\, and Justice and an affiliate faculty member in the School of Social Work and the Department of Sociology.
