SUMMARY:Fundamentals of Mediation
DESCRIPTION:  \n  \nA 40-hour basic mediation training program\, including certificate of completion and optional MCLE credit. \nThe UC Law SF Center for Negotiation and Dispute Resolution (CNDR) presents its’ annual 40-hour comprehensive mediation practitioner training. This program provides a unique blend of mediation theory\, hands-on mediation skills training\, and an exploration of the sensibilities and personal qualities required to be an effective mediator. \nThis in-person program is useful for a range of professionals who deal with people in conflict\, and any attorney who represents clients in mediation\, to understand the process and to be more effective in representing clients in mediation. We also encourage participation of international attorneys\, notaries and Hastings LL.M. students. No prior training or experience required. \n\n \nIn this highly interactive and dynamic training\, participants from around the world learn the theory and practice of mediation. The methodology consists of a mixture of discussion\, skill building exercises and role play. All participants will have the opportunity to practice multiple times in the client\, advocate and mediator roles and will receive personalized feedback and coaching from professional mediators. \nWe start with the psychology and behavior of people in conflict and the different process choices parties can make when seeking to resolve conflict. We examine the different styles or models of mediation and the implications of those models for the client experience. We then explore and practice every phase of a mediation\, from opening and setting the stage\, to exploration of interests and issues\, negotiating agreements\, preparation of settlement documents and closure. \n  \n \n\nCombined with the practice of these phases\, participants build critical communication and process management skills including how to: \n\nMaintain neutrality\nBalance power\nSelect appropriate influencing strategies\nDecide whether\, when and how to use private sessions (“caucus”)\nFacilitate the “money dance”\nConduct a methodical alternatives analysis\nEmploy techniques for overcoming impasse\nConvey “difficult” messages\nUse active listening\nAsk questions to move the clients in helpful directions\nHandle difficult behavior and “reframe” problematic statements\n\nFinally\, we cover mediator ethics\, process confidentiality\, working with representatives and co-mediation. \n  \nWhat participants have to say: \n“Fantastic! So happy I chose this program\, it blew away my expectations. The role playing was especially valuable to measure progress and enforce the teaching.” – BT 2022 \n  \n“I quit my job as a teacher to work in the Office of Civil Rights doing in-house dispute resolution and mediation. I could not have gotten this position without taking CNDR’s Fundamentals of Mediation Training\, and I am so grateful for all of the skills I gained. I re-read Prof. Ford’s Peace at Work and feel even more prepared to take on this next challenge.” – BL\, 2024 \n\nFormat\nAll 40 hours will take place in-person during a live class\, including small group role plays with individualized coaching. Each day includes 1.5 hours of total breaks. \nDates\nMonday\, August 31 – Friday\, September 4\, 2026 from 8:30 a.m. – 6:00 p.m. each day (PST) \nLocation\nUC Law SF\, 198 McAllister\, San Francisco\, CA 94102 (in-person training only) \nMCLE\n40 hours of California MCLE credits available\, including 1.5 hrs Elimination of Bias and 2 hrs Legal Ethics. SUMMARY:CEALS Presents - China's Jurisdictional Maximalism
DESCRIPTION:Please join the Center for East Asian Legal Studies for a talk with Junhao Chen\, who will explore the aggressive expansion of control by Chinese courts over litigation implicating China’s overseas interests\, a strategy that extends beyond critical patents in the telecom sector to cover a broader set of international commercial disputes. A light lunch will be served.\n  \n\nFeatured Speaker: Junhao Chen\, JSD Candidate\, NYU School of Law\nDate/Time: Wednesday\, September 9\, 2026\, 12:30-1:30 PM\nLocation: Room 333-201 (UC Law SF\, 333 Golden Gate Ave\, Room 201)\n\n\n\n  \n\n\n\n\nIn 2020\, China began asserting judicial authority in ways that encroached upon the legal sovereignty of other jurisdictions around the world\, including the United States. The front line of this incursion was an unprecedented wave of “anti-suit injunctions” issued by Chinese courts: judicial orders preventing non-Chinese litigants from suing\, or continuing to sue\, in other jurisdictions. Many scholars appear to regard these injunctions as reasonable\, legitimate tools to protect the integrity of Chinese adjudication. Even those few critics who have raised concerns tend to frame such injunctions as unique features of transnational patent litigation in the telecom sector. Chen’s new article argues that the wave of anti-suit injunctions should be understood\, instead\, as both the starting point and a crucial element of China’s grand strategy of jurisdictional maximalism: that is\, the aggressive expansion of control by Chinese courts over litigation implicating China’s overseas interests. This strategy extends beyond critical patents in the telecom sector to embrace a broader set of international commercial disputes. Drawing on a review of Chinese judicial opinions\, official statements\, and trends in legal doctrine—most of which are unavailable in English translation—Chen reveals the scale of the emerging jurisdictional paradigm.\n  \nHybrid Event — This event will be live-streamed via Zoom. Virtual attendance is optional. \n  \nClick here to RSVP or Register for Zoom

SUMMARY:Fall 2026 ADR Speaker Series - Last Resorts: Using Counter-Design in ADR and Beyond
DESCRIPTION:Wednesday\, September 23\, 2026 from 12:30-1:30pm (PT)\nLast Resorts: Using Counter-Design in ADR and Beyond\nDan Berstein\, MHS | MH Mediate \nAndrew Mamo\, Professor of Law\, University of Cincinnati\, Donald P. Klekamp College of Law \nVia Zoom \nRSVP HERE \nCollaborative conflict resolution processes aren’t always possible\, especially in bureaucracies where communication is limited. When all else fails\, rejected parties can still make progress: Andrew Mamo introduced a theory of “counter-design\,” where parties challenge and reimagine dispute resolution systems through activities like unveiling\, tagging\, and assembling. An example is Dan Berstein’s work convincing dispute resolution organizations to update policies that were stigmatizing mental illness. This workshop uses Dan’s stories as counter-design case studies. Participants will receive tools they can use right away to [1] create better systems so there is no need for counter-design\, and [2] apply counter-design strategies when stuck in a system that is not working. \n  \nAndrew Mamo\nAndrew Mamo is a professor of law at the University of Cincinnati Donald P. Klekamp College of Law. His research concerns the history and theory of dispute resolution and negotiation\, with an emphasis on the history of dispute resolution practices\, the role of technology in dispute resolution\, and the professionalization of dispute resolution. His current projects include a study of the institutionalization of dispute resolution services in the late twentieth century. Mamo received his SB in physics from the Massachusetts Institute of Technology\, his PhD in history from the University of California\, Berkeley\, and his JD from Harvard Law School. After graduating from law school\, Mamo clerked for Judge Hisashi Owada and Judge Julia Sebutinde of the International Court of Justice in The Hague. He then worked on cross-border capital markets and project finance transactions at a major international law firm in Singapore. Mamo joined Harvard Law School as Lecturer in Law and a Clinical Instructor at the Harvard Negotiation and Mediation Clinical Program\, teaching negotiation and supervising teams of clinical students representing clients on a range of dispute systems design projects. Prior to joining the College of Law\, he was an Assistant Professor of Law at Northern Illinois University College of Law. \n  \nDan Berstein\nDan Berstein is a mediator living with bipolar disorder\, working to adapt conflict resolution best practices to promote empowering mental health communication and prevent mental illness discrimination. Since 2012\, Dan’s company\, MH Mediate\, has helped professionals\, organizations\, and government agencies address challenging behaviors without discriminating against people who have mental health conditions. MH Mediate provides free resources to help different stakeholders use conflict resolution tools to prevent mental illness stigma. They are hosted on the Dispute Resolution In Mental Health Initiative (DRMH Initiative) website\, originally funded by the AAA-ICDR Foundation and developed in partnership with the CUNY Dispute Resolution Center. MH Mediate’s Mental Health Safe Project (MH Safe) also provides free addendum content to parties affected by discriminatory guidance about mental illness. Its DisabilityRadar.com website empowers people to anonymously report problems. Dan leads the Rights\, Ethics\, and Voices in Dispute Resolution (REV-DR) project to help parties know their rights and how to respond to misconduct. Mitchell Hamline School of Law’s DRI Press recently published a new edition of Dan’s book\, Mental Health and Conflicts: A Handbook for Empowerment\, which was originally published by the ABA. Dan holds degrees from the Wharton School and the Johns Hopkins School of Public Health. \n  \nFor more information on the Fall 2026 ADR Speaker Series\, please visit the CNDR website. \n

SUMMARY:Fall 2026 ADR Speaker Series: Against Overbroad Nondisclosures
DESCRIPTION:Wednesday\, October 7\, 2026 from 12:30-1:30pm (PT)\nAgainst Overbroad Nondisclosures\nGilat Bachar\, Associate Professor\, Temple University Beasley School of Law \nVia Zoom \n  \nSettlement NDAs routinely impose sweeping and often perpetual confidentiality obligations\, yet courts rarely scrutinize their breadth\, leaving many plaintiffs unable to discuss traumatic experiences even with trusted confidants and thereby exacerbating psychological harm. To address these costs\, I propose that courts recognize implied mandatory carve-outs for emotionally taxing events\, allowing limited disclosures to professionals and close confidants and recalibrating contract enforcement to better protect vulnerable parties’ well-being. \n  \nGilat Juli Bachar is an Associate Professor of Law at Temple University Beasley School of Law\, where she teaches and writes in the areas of legal ethics\, tort law\, dispute resolution\, and law and psychology. Her paper “Plaintiffs’ Lawyers’ Disclosure Duties” was the winner of the 2025 Warren E. Burger Prize. Bachar’s research combines theoretical analysis with empirical methods to explore how people perceive and make decisions about civil litigation and settlement\, and how civil justice institutions can balance private dispute resolution with the public values of transparency\, accountability\, and social welfare. Before joining Temple\, she was a Visiting Assistant Professor at Villanova School of Law\, a research fellow at the Stanford Center on the Legal Profession and a litigation fellow at the Center for Justice & Accountability in San Francisco. \n  \nRSVP \n  \nMore information on the Fall 2026 Speaker Series \n

SUMMARY:Fall 2026 ADR Speaker Series: Rethinking Active Listening in ADR
DESCRIPTION:  \nWednesday\, October 14\, 2026 from 12:30-1:30pm (PT)\nRethinking Active Listening in ADR\nNicolas Parra-Herrera\, Associate Professor\, Wagner/Holbrook Chair in Negotiation\, S.J. Quinney College of Law\, University of Utah \nIn Person – Deb Colloquium Room @ UC Law SF and Via Zoom \n  \nActive listening has become an overarching concept in ADR\, yet there is no precise discussion of its definition\, what it encompasses\, and how it has filtered into the field. It dissolves into a set of protocols\, communication techniques\, and rhetorical claims that fail to account for the limitations\, potentials\, and contingency of listening. In this talk\, we will analyze what the mandate to “active” listening means in ADR literature. We will show that this literature mixes active listening as a moral mandate\, a professional skill\, and a way of relating to others and oneself. In the second part\, we will show how the pervasive use of active listening discourse conceals its power to distribute the audible among the parties and forecloses other practices of listening in ADR. \n  \nRSVP \nMore information on the Fall 2026 ADR Speaker Series \n  \n

SUMMARY:Fall 2026 ADR Speaker Series - ISO Truth: Truth-Seeking and Relational Agency in the Aftermath of Gender-Based Violence
DESCRIPTION:Wednesday\, October 28\, 2026 from 12:30-1:30pm (PT)\nISO Truth: Truth-Seeking and Relational Agency in the Aftermath of Gender-Based Violence\nRachel J. Wechsler\, Associate Professor\, University of Missouri School of Law \nVia Zoom \nRSVP \n  \nGender-based violence survivors’ pursuit of truth is often complicated by systemic discounts to their credibility\, institutional resistance\, and\, particularly in recent years\, a post-truth epistemic environment. Despite these challenges\, survivors consistently exercise individual and collective agency in pursuit of truth in the aftermath of their victimization. I draw on transitional justice and relational agency theory to explore the contours and significance of truth-seeking in relation to gender-based violence\, both for survivors and for wider society. \n\n  \nRachel J. Wechsler is an Associate Professor and the Assistant Director of the Center for the Study of Dispute Resolution at the University of Missouri School of Law. She is also a Faculty Scholar at the University of Missouri’s Middleton Center for Race\, Citizenship\, and Justice and an affiliate faculty member in the School of Social Work and the Department of Sociology. Professor Wechsler researches gender-based violence at the intersection of Criminal Law\, Family Law\, Dispute Resolution\, and Human Rights. \n  \nMore information on the ADR Speaker Series
