SUMMARY:Fall 2026 ADR Speaker Series: Against Overbroad Nondisclosures
DESCRIPTION:Wednesday\, October 7\, 2026 from 12:30-1:30pm (PT)\nAgainst Overbroad Nondisclosures\nGilat Bachar\, Associate Professor\, Temple University Beasley School of Law \nVia Zoom \n  \nSettlement NDAs routinely impose sweeping and often perpetual confidentiality obligations\, yet courts rarely scrutinize their breadth\, leaving many plaintiffs unable to discuss traumatic experiences even with trusted confidants and thereby exacerbating psychological harm. To address these costs\, I propose that courts recognize implied mandatory carve-outs for emotionally taxing events\, allowing limited disclosures to professionals and close confidants and recalibrating contract enforcement to better protect vulnerable parties’ well-being. \n  \nGilat Juli Bachar is an Associate Professor of Law at Temple University Beasley School of Law\, where she teaches and writes in the areas of legal ethics\, tort law\, dispute resolution\, and law and psychology. Her paper “Plaintiffs’ Lawyers’ Disclosure Duties” was the winner of the 2025 Warren E. Burger Prize. Bachar’s research combines theoretical analysis with empirical methods to explore how people perceive and make decisions about civil litigation and settlement\, and how civil justice institutions can balance private dispute resolution with the public values of transparency\, accountability\, and social welfare. Before joining Temple\, she was a Visiting Assistant Professor at Villanova School of Law\, a research fellow at the Stanford Center on the Legal Profession and a litigation fellow at the Center for Justice & Accountability in San Francisco. \n  \nRSVP \n  \nMore information on the Fall 2026 Speaker Series \n

SUMMARY:Fall 2026 ADR Speaker Series: Rethinking Active Listening in ADR
DESCRIPTION:  \nWednesday\, October 14\, 2026 from 12:30-1:30pm (PT)\nRethinking Active Listening in ADR\nNicolas Parra-Herrera\, Associate Professor\, Wagner/Holbrook Chair in Negotiation\, S.J. Quinney College of Law\, University of Utah \nIn Person – Deb Colloquium Room @ UC Law SF and Via Zoom \n  \nActive listening has become an overarching concept in ADR\, yet there is no precise discussion of its definition\, what it encompasses\, and how it has filtered into the field. It dissolves into a set of protocols\, communication techniques\, and rhetorical claims that fail to account for the limitations\, potentials\, and contingency of listening. In this talk\, we will analyze what the mandate to “active” listening means in ADR literature. We will show that this literature mixes active listening as a moral mandate\, a professional skill\, and a way of relating to others and oneself. In the second part\, we will show how the pervasive use of active listening discourse conceals its power to distribute the audible among the parties and forecloses other practices of listening in ADR. \n  \nRSVP \nMore information on the Fall 2026 ADR Speaker Series \n  \n

SUMMARY:Reflective Mediation Practice Group
DESCRIPTION:Bring your mediation practice to the next level by participating in a reflective practice group! \nReflective practice groups are among the most effective ongoing learning experiences available to mediators. Under the guidance of an experienced mediator and facilitator\, a small group of mediators meets regularly to take turns reflecting on their individual mediation cases. The group supports the mediator presenting a case to discover what mediator interventions worked best and what mediator behaviors created challenges. This collaborative exploration enhances awareness of the dynamics at play and increases the potential of learning from each mediation experience. Participants will be expected to anonymize all case identifying information so as to ensure strict confidentiality. \nBeginning in January 2026\, the Center for Negotiation and Dispute Resolution (CNDR) at UC Law San Francisco will offer a 6-session monthly practice group led by experienced mediator and mediation trainer Howard Herman. Currently a mediator at JAMS\, Howard pioneered the use of practice groups for mediators at the U.S. District Court in San Francisco where he led the court’s ADR Program for 23 years\, and where many mediators participated continuously in groups he led for over 15 years. Howard also has led practice groups for mediators in India and Brazil. Howard’s fuller biography can be found at jamsadr.com/herman. \n  \nGroup Structure and Approach \nThe group will meet in person. It will be limited to 12 participants and is open to all practicing mediators. Generally\, each session will be focused on mediator presentations of cases in which they have been involved. Rather than starting with a topic\, discussion flows from what actually happened and the choices the mediator made throughout the process. \nKey to a successful group is the creation of a safe and confidential environment of mutual support and respect\, making stable membership and small group size important. Participants commit to in-person attendance at all six two-hour sessions\, and to write up and present at least one case for discussion during the six-month period. \nMCLE: 12 hours general credit for the series\, including 1 hour of elimination of bias credit (excludes implicit bias/bias reducing strategies)\, 1 hour of competence credit (excludes prevention and detection)\, and 1 hour of ethics credit \nCost: $595 for the full series \nIf you are interested in joining the group\, please complete this application. \nApplications will be taken on a rolling basis until the group is full.

DESCRIPTION:Wednesday\, October 28\, 2026 from 12:30-1:30pm (PT)\nISO Truth: Truth-Seeking and Relational Agency in the Aftermath of Gender-Based Violence\nRachel J. Wechsler\, Associate Professor\, University of Missouri School of Law \nVia Zoom \nRSVP \n  \nGender-based violence survivors’ pursuit of truth is often complicated by systemic discounts to their credibility\, institutional resistance\, and\, particularly in recent years\, a post-truth epistemic environment. Despite these challenges\, survivors consistently exercise individual and collective agency in pursuit of truth in the aftermath of their victimization. I draw on transitional justice and relational agency theory to explore the contours and significance of truth-seeking in relation to gender-based violence\, both for survivors and for wider society. \n\n  \nRachel J. Wechsler is an Associate Professor and the Assistant Director of the Center for the Study of Dispute Resolution at the University of Missouri School of Law. She is also a Faculty Scholar at the University of Missouri’s Middleton Center for Race\, Citizenship\, and Justice and an affiliate faculty member in the School of Social Work and the Department of Sociology. Professor Wechsler researches gender-based violence at the intersection of Criminal Law\, Family Law\, Dispute Resolution\, and Human Rights. \n  \nMore information on the ADR Speaker Series
