Rethinking Active Listening in ADR

Active listening has become an overarching concept in ADR, yet there is no precise discussion of its definition, what it encompasses, and how it has filtered into the field. It dissolves into a set of protocols, communication techniques, and rhetorical claims that fail to account for the limitations, potentials, and contingency of listening. In this talk, we will analyze what the mandate to “active” listening means in ADR literature. We will show that this literature mixes active listening as a moral mandate, a professional skill, and a way of relating to others and oneself. In the second part, we will show how the pervasive use of active listening discourse conceals its power to distribute the audible among the parties and forecloses other practices of listening in ADR.
